A land lease agreement is concluded in cases when real estate is leased to a building where there are no buildings or structures. In cases where the land belongs to one party and the building or structure to the other party, a Agreement on the Establishment of Building Rights must be concluded.

 

Essential things to be specified in the land lease agreement:

  • Information on the real estate plot available in the land register.
  • Lease term.
  • The purpose for which the land will be used (type of business or, for example, agricultural purposes).
  • The amount of the rent (clearly indicated with or without VAT if the lessee is a VAT payer) and the date when it is due.
  • The amount of the security, if any, and the procedure for its use and the repayment term.
  • The parties are advised to clearly stipulate the rights and obligations they may have in the use of a particular plot of land, depending on the type and purpose of its use.
  • It must be indicated whether the land lease agreement will be registered in the Land Register (if it is registered in the Land Register, then it is also binding on the next owner of the land plots, if the lessor disposes of the land plot (eg sells it) to someone else).
  • The boundary plan of the land plot is usually attached to the contract.
